These Terms of Service (“Terms”) govern your use of the Murmur website and your purchase of the Murmur smart ring. By placing a pre-order or using our website, you agree to these Terms.

Murmur is a product of Fable Engineering Inc., a company incorporated in Delaware, United States.

1. Pre-order and product development

The Murmur smart ring is currently in development. When you place a pre-order, you are purchasing a reservation for a product that has not yet shipped. You understand and agree that:

• The product is in active development and final specifications, features, and design may differ from what is shown on our website.
• Our estimated shipping date of Summer 2026 is a good-faith estimate and is subject to change. Hardware development involves uncertainties that may affect timelines.
• If we make material changes to the product or timeline, we will notify you and you will have the option to receive a full refund.

2. Pricing and payment

The Murmur pre-order uses a two-step payment model:

• A $10 refundable deposit reserves your Murmur Ring at the early-bird price of $149 (retail $299).
• The remaining balance of $139 will be charged before your order ships (estimated Summer/Q4 2026).
• We will send you an email notification before charging the remaining balance.
• You may cancel at any time before the remaining balance is charged and receive a full refund of your $10 deposit.

The early-bird package includes the Murmur smart ring, charging case, and 3 months of Murmur AI free. After the trial, the AI subscription is $8.99/month. All payments are processed through Stripe, our third-party payment processor. All prices are in US dollars.

3. Refunds and cancellations

$10 deposit: Fully refundable at any time before the remaining balance is charged. No questions asked. Simply contact us at [email protected].

After full payment ($149 total): Fully refundable at any time before your order ships. Refunds are processed within 5–10 business days to your original payment method.

For full details, see our Refund Policy. We reserve the right to cancel any order and issue a full refund at our discretion, including in cases where we determine we cannot fulfill the order.

4. Shipping and delivery

We currently estimate shipping will begin in Summer 2026. This is an estimate only and not a guaranteed delivery date. If there are significant changes to this timeline, we will notify you by email and offer you the option of a full refund.

In compliance with the FTC Mail, Internet, or Telephone Order Merchandise Rule, if we are unable to ship within the stated timeframe, we will notify you of the revised date and provide the option to cancel for a full refund.

5. Limitation of liability

To the fullest extent permitted by law, Fable Engineering Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your pre-order or use of the Murmur product, including but not limited to delays in delivery caused by factors beyond our reasonable control (supply chain disruptions, manufacturing delays, regulatory requirements, or force majeure events).

Our total liability to you for any claim arising from these Terms or your pre-order shall not exceed the amount you paid for your pre-order.

6. Intellectual property

All content on this website — including text, images, logos, and design — is the property of Fable Engineering Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

7. Privacy

Your use of our website and any information you provide are governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the website or maintenance of your pre-order after such changes constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
